These Terms of Service (“Terms”) govern all use of the website salesplay.hasicloud.com (“Website”) and all purchases of digital products offered through it, including Executive Sales Plays and Deep Research Reports (“Digital Products”).

By accessing the Website or purchasing a product, the Customer (“you”) agrees to these Terms.

All transactions are processed through Paddle Payments Ltd., which acts as the legal seller and Merchant of Record.

4. Nature of Products and Delivery

Products offered are digital only.
After successful payment, delivery occurs automatically by email or download link - normally within minutes.

There is no physical shipment.
To access the files, you require a modern PDF reader and a working email address.

All reports and materials are generated through proprietary AI-assisted workflows designed by the Creator.

Independent Development Disclaimer

All software workflows, automation logic, and AI prompts used to generate the Digital Products were developed independently by the Creator, on privately owned hardware and during personal time, without the use of any employer resources or confidential information.
These assets and related rights are the sole property of the Creator and are not affiliated with any current or former employer.

No proprietary, internal, confidential, or employer-derived information has been used in the creation of the Executive Sales Plays, including all templates, reports, research outputs, and underlying automation workflows. All content is based solely on publicly available information, original work, and user-provided inputs.

All workflows and templates were built without access to vendor-specific proprietary datasets, partner portals, CRM systems, or restricted materials from any employer or affiliate.

6. Pricing, Taxes, and Invoicing

Prices are shown in euros (EUR) and include applicable VAT or sales tax as determined by Paddle.com Market Ltd.
Invoices are issued by Paddle.com Market Ltd. on behalf of the Merchant of Record.
Currency conversions or bank fees are handled by your payment provider.

Payments primarily cover the technical, computational, and curation costs associated with generating each customized report, not the transfer of ownership of any underlying system or intellectual property.

7. Right of Withdrawal (EU Consumers)

Under EU Directive 2011/83/EU, consumers normally have a 14-day right of withdrawal for distance contracts.

For digital content not supplied on a tangible medium, this right expires once performance begins after your explicit consent and acknowledgment of losing the right of withdrawal.

During checkout you are asked to confirm:

“I agree to immediate access to the digital content and acknowledge that my 14-day right of withdrawal expires once delivery has begun.”

If you do not give consent and delivery has not begun, you may withdraw within 14 days by emailing ostermann . manfred @ gmail . com .
Refunds, where applicable, are processed by Paddle.com Market Ltd.

8. Disclaimer of Warranty and Limitation of Liability

Digital Products are generated automatically based on data inputs and AI models.
They are intended for informational purposes only and do not constitute professional, financial, or strategic advice.

While the Creator exercises care in designing the workflows and reviewing results, no guarantee is made that the content is complete, accurate, or fit for a specific purpose.

To the maximum extent permitted by law, the Creator is not liable for indirect, incidental, or consequential damages, including loss of profits or data.
Mandatory consumer rights under Austrian and EU law remain unaffected.

9. Service Availability and Maintenance

The automation workflows run on privately maintained systems.
Although best efforts are made to ensure availability, no specific uptime, response time, or delivery speed is guaranteed.
Temporary interruptions may occur due to maintenance, updates, network issues, or the Creator’s absence (e.g., business travel).
Such interruptions do not constitute defects or non-performance.

No Service Level Agreement (SLA)

This service is provided on a best-effort basis.
The Creator provides no SLA or guaranteed support timelines.
Customers acknowledge that availability and response times may vary.

10. Technical Requirements and Compatibility

To use the Digital Products, you must have:

No specific operating system or browser is required.
You are responsible for ensuring your environment meets these requirements.

11. Force Majeure

We are not responsible for failure or delay in performance due to causes beyond our reasonable control, including natural disasters, internet outages, third-party service disruptions (e.g., n8n, Cloudflare, Paddle.com Market Ltd.), or power failures.

12. Data Protection

Your personal data are processed in accordance with our Privacy Policy.
By using this Website or purchasing a product, you acknowledge that you have read and accepted that policy.

13. Governing Law and Jurisdiction

These Terms are governed by Austrian law.
For consumers, mandatory protections under their national consumer law remain unaffected.
For business customers, the exclusive place of jurisdiction is Vienna, Austria.

14. Amendments to the Terms

We may update these Terms from time to time to reflect changes in law, technology, or business practices.
The version in effect at the time of your purchase governs that transaction.
Revised Terms become effective upon publication on this Website.

15. Dispute Resolution

The EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025.
We are not obliged and generally not willing to participate in alternative dispute resolution before a consumer ADR body unless legally required.

16. Severability and Language

If any provision of these Terms is held invalid, the remaining provisions remain in full effect.
The contractual language is English; in case of translation discrepancies, the English version prevails.
